Agreement to Terms

By downloading, installing, or using Ascent ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Ascent is a habit-tracking application that helps users build positive habits through:

• Habit and goal tracking
• AI-powered coaching
• Screen Time monitoring (with permission)
• Home screen widgets
• A structured 70-day curriculum

Subscriptions and Payments

Free Tier (Standard)

• Up to 5 habits
• 15 AI coach messages per day
• 7-day curriculum preview

Subscriber Tier ($4.99/month or $49.99/year)

• Up to 15 habits
• 20 AI coach messages per day
• Full 70-day curriculum

Architect Tier ($11.99/month or $99.99/year)

• Unlimited habits
• 50 AI coach messages per day
• Full 70-day curriculum

Billing

• Subscriptions are billed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

Refunds

• Refund requests must be made through Apple
• We do not process refunds directly

User Responsibilities

You agree to:

• Use the App for lawful purposes only
• Not attempt to reverse engineer, modify, or hack the App
• Not use the App to harass, abuse, or harm others
• Provide accurate information when using the App
• Keep your device secure

AI Coach

Nature of AI Advice

• The AI coach provides general guidance and motivation
• It is not a substitute for professional medical, psychological, or therapeutic advice
• If you are struggling with mental health issues, please consult a qualified professional

AI Limitations

• AI responses are generated by third-party providers (Google, Anthropic, OpenAI)
• We do not guarantee the accuracy or appropriateness of AI responses
• The AI may occasionally produce incorrect or unhelpful responses

Intellectual Property

• The App, including its design, code, and content, is owned by Ascent
• You may not copy, modify, or distribute the App without permission
• Your habit data and journal entries remain yours

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The App will be error-free or uninterrupted
• The App will meet your specific requirements
• Results from using the App will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of data or profits
• Any damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App in the past 12 months.

Indemnification

You agree to indemnify and hold harmless Ascent and its developers from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, without notice, for:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App

Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
